What are the visas available for working in the US?

The employee must intend to remain in the United States temporarily, for no longer than the term of the visa. You may apply for a B1 or an H-1B visas as suitable.

B-1 Visa is to visit the US for short duration (3 to 6 months) for a specific task project. For obtaining a B-1 visa your employer you must be able to show that you are maintaining a foreign residence and will engage in only legitimate activities as relates to the exact purpose of the visit.

The H-1 Visa is for temporary professional employment with the US employer. The H1 is valid for three years and can be extended for a further period of three years. For obtaining an H1 visa you must have a job offer from a United States employer to perform services in the specialty area within the US. The employee must have background to qualify for the job.

What is required in addition to an employment letter from a US employer to obtain a work visa?

All education and experience documents, the passport and any other document as may be demanded by the US visa authority during the processing of the visa application.

Medical certification is also a required to obtain the US visa. The examination is conducted by a medical practitioner authorized by the visa office.

Who can accompany me while I am on the H1-B visa to US?

H-4 Visas are granted for spouses and unmarried defendant children under 21. H-4 visas authorize your family members only to stay, not to work in the US.

Other friends or relatives, if need be, can visit you with short duration visa called B-2. Applicants visiting you with a B2 visa should prove that they have a home, bank accounts, family ties etc. in their home country.

What are the limitations in terms of visa duration?

Nonimmigrant visas can be issued for a length of time as allowed by law, depending on the type of visa. All visas issued have an expiration date, before on which the visa holder must leave the country OR get the visa extended. All the extensions vary in length and number according to the type of the visa. Work visa for example cannot be extended beyond a period of six years.

After the expiry of the visa, can I apply for another H-1B non immigrant visa?

The employee must reside abroad for 1 year after expiration of his/her six year visa term before applying for another H-1B nonimmigrant visa

What is Labor Certification?

The labor certification is filed by the employer before filing the application for the visa. It is an authorization to an employer that permits the immigration of a foreign worker. The labor certification is concerning the employer's offered wage and working conditions and a prospective employee is not involved at all. Labor certification cannot be transferred to another company

How much time does the labor certification process take?

The entire process of labor condition attestation and petition approval takes around 4 to 8 weeks and visas in normal cases take several weeks after petition approval

Once I have a labor certification approved in my name, what benefits will I get?

The labor certification does not provide any benefits to the employee until the employer who has obtained it files the I-140. The labor certification only certifies a shortage in the job category at the employer's site.

Can the labor certification obtained in my name, be used by the employer for other employee instead?

Yes. The company has all rights to change the employee that it was originally filed for. The labor certification is about a job, it does not "belong" to anyone except the company

Can the employer use the labor certification again, say if I resign am terminated?

Yes. If the employee ceases to be with the company due to any reason, the employer may reuse the permit for another employee.
